Mr.Arun Kumar Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 30-08-2025 Heard Mr. Ghanshyam, learned counsel appearing on behalf of the petitioner and Mr. Arun Kumar Pandey, learned APP for the State.

2. Learned counsel appearing on behalf of the petitioner informs that opposite party no.2 is avoiding to receive the notice and matter is purely civil in nature. He further submitted that an amount of Rs.9,95,000/- has already been returned back to the informant, Ranjit Singh and the remaining amount, if any, will be returned to the informant very soon.

3. Considering the aforesaid submissions made on behalf of the petitioner, I find that the matter can be resolved

Patna High Court CR. MISC. No.3015 of 2024(3) dt.30-08-2025 2/3 outside the Court by way of mediation.

4. The petitioner is directed to appear before the learned District Court on 15.09.2025 sharp at 10:30 a.m.

5. Learned District Court is directed to take necessary action to refer the matter before the learned mediator of the District Mediation Center.

6. Learned Mediator of the District Mediation Center concerned shall make his/her best efforts to settle the dispute amicably and thereafter submit his/her report before the concerned learned District Court, well within a period of four months, till then, no coercive action shall be taken against the petitioner in connection with the Shrikrishna Puri P.S. Case No.35/2009.

7. In case of failure on the part of the petitioner to appear on 15.09.2025 before the learned District Court or any date fixed by the learned Mediator, the interim protection granted to the petitioner shall automatically lose its force.

8. In case, the O.P. No.2 fails to appear on the date fixed by the learned District Court, then in that case, the learned District Court shall ensure his presence by directing the Senior Superintendent of Police, Patna to produce the O.P. No.2 before the Court.

9. Petitioner's counsel undertakes that petitioner will inform O.P. No.2 personally, so that they can proceed to resolve the dispute amicably.

10. Accordingly, the present application stands disposed of.
