JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-01-2024 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State. Earlier, vide order dated 19.04.2023, provisional bail was given to the petitioner by the co-ordinate Bench of this Court with a condition to deposit the entire due maintenance amount to O.P. No.2 in her bank account in five equal installments. Learned counsel for the petitioner submits in para-3 of his supplementary affidavit that as per the order by the Hon'ble Court on 19.04.2023, granted provisional regular bail on two conditions and both of them is already fulfilled by the petitioner as he has paid due maintenance of Rs. 3,40,000 in eight installments and before that Rs. 3,79,000/- was already paid. Patna High Court CR. MISC. No.2847 of 2023(6) dt.23-01-2024 2/2 the amounts are paid in the Account No. 00060100022170. Petitioner has already provided one room to the informant for her survival. Also, an application and receipt of paid amount have filed in the Court of learned Principal Judge in the Family Court, Bhojpur at Ara in Civil Misc. No. 30/2017 on 23.09.2023 and in support of these, a photo copy of the application to learned Principal Judge in Family Court, Bhojpur at Ara along with the receipt of amount paid on 23.09.2023 is being annexed herewith and is marked as Annexure-P/3 of this petition. Learned counsel for the informant submitted from para-4 of the reply to the supplementary affidavit that petitioner has not obeyed the conditions of the joint compromise petition dated 18.01.2021 and he still tortures her. Further, the informant has right to claim arrear, if any.
Considering the aforesaid facts and circumstances, the provisional bail granted to petitioner vide order dated 19.04.2023 by another co-ordinate Bench of this Court is hereby confirmed. This application stands allowed.
