The petitioner seeks bail in Jamo Bazar P.S. Case No.148 of 2018 under Sections 379, 411, 413, 414 and 34 of the Indian Penal Code.

The informant alleged that the petitioner and others were committing theft of electric wire but when the informant reached there, petitioner and others started fleeing away. On chase, petitioner was apprehended.

The learned counsel for the petitioner submits that the petitioner was coming from the house of his relatives but on wrong identification and misunderstanding, the petitioner was apprehended. Similarly situated co-accused namely, Digvijay Nath Tiwari has been granted bail. Petitioner is in jail since 07.09.2018. Petitioner has already remained in jail for more than
