JUSTICE SHIVAJI PANDEY ORAL ORDER 10-07-2020 Heard learned counsel for the petitioners and learned APP for the State through virtual Court proceeding. In this case, the petitioners are seeking anticipatory bail in connection with Khagaria P.S. Case No.345 of 2019, registered for the offence under Sections 341, 323, 504, 506, 379, 325 and 307/34 of the Indian Penal Code. As per the F.I.R., on account of opening of window in a constructed house some altercation took place between the parties. Allegation has been made against these petitioners to have assaulted the informant with the butt of three-nut. Learned counsel for the petitioners submits that it
Patna High Court CR. MISC. No.71825 of 2019(3) dt.10-07-2020 2/2 is completely a manufactured story in order to implicate the petitioners in the false case. He further submits that there is a delay of 24 days in lodging the F.I.R. and that too without any explanation as the alleged incident has taken place on 01.05.2019 whereas the F.I.R. has been lodged on 25.05.2019. Considering the fact that there is a delay of 24 days in lodging the F.I.R. and that too without any explanation, let the above-named petitioners be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Khagaria, in connection with Khagaria P.S. Case no.345 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
