The petitioner seeks bail in a case registered under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code. The prosecution case in short is that in the backdrop of making electric wire, an altercation took place between the parties and in consequence thereof, the accused persons having armed, surrounded the informant and assaulted him as a result of which, the informant and others received injuries. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 02-08-2019. Charge sheet has already been submitted. There is case and counter case between

Patna High Court CR. MISC. No.73492 of 2019(2) dt.19-11-2019 2/2 the parties. Both parties are agnates. The injury on the side of the accused has not been explained by the prosecution. The prosecution has not come with clean hands.

On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-V, Darbhanga in connection with Manigachhi P.S. Case No. 147 of 2019.
