02. In the present case, the petitioner seeks bail in connection with Pirpainti P.S. Case No. 46 of 2023 registered for the alleged offences under Sections 147, 149, 341, 323, 504, 506, 307 and 302 of the Indian Penal Code.
03. As per prosecution case, the petitioner along with other FIR named accused persons caused death of father of the informant. Further, the petitioner and co-accused Niranjan Mandal assaulted the informant with rod on his head, causing injuries to him.
04. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to money dispute. There is delay of four days in
Patna High Court CR. MISC. No.80165 of 2025(2) dt.01-12-2025 2/3 lodging the FIR for which there is no satisfactory explanation. Learned counsel further submits that only allegation against the the petitioner and co-accused Niranjan Mandal is of assaulting the informant with rod but no injury report of the informant has been brought on record and the allegation of assault on the father of the informant causing fatal injury to him is against coaccused Santosh Mandal. Similarly placed co-accused, Niranjan Mandal, has been granted bail by a Co-ordinate Bench vide order dated 30.08.2024 passed in criminal Misc. No. 47828 of 2024. The petitioner is having clean antecedent and is in custody since 27.02.2025. Charge-sheet has been submitted.
05. Learned APP for the State opposes the submission made on behalf of the petitioner.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the period of custody of the petitioner and his clean antecedent along with submission of charge-sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI, Bhagalpur/court concerned in connection with Pirpainti P.S. Case No. 46 of 2023, subject to the conditions
Patna High Court CR. MISC. No.80165 of 2025(2) dt.01-12-2025 3/3 mentioned in Section 480(3) of BNSS and the following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
