The petitioner is languishing in custody since 06.09.2019 in a case registered for the offences punishable under Sections 461 and 380 of the Indian Penal Code. On theft being committed in the shop of the informant of cosmetics and a stabilizer worth Rs.1,25,000/-, FIR was registered against unknown. Subsequently, on the confession of the petitioner, he has been made accused.

It is submitted by learned counsel for the petitioner that there is no recovery from the possession of the petitioner. However, petitioner is accused in one another case but he is on bail in that case, statement to that effect has been made in paragraph 3 of the petition.

Patna High Court CR. MISC. No.69398 of 2019(2) dt.27-11-2019 2/2 Learned APP submits that the petitioner has confessed his guilt.

Considering the fact that the investigation has already been concluded, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Azamnagar P.S. Case No. 210 of 2019.
