The petitioner seeks bail in a case registered under Section 414 of the Indian Penal Code and 11(a)(d) of Prevention of Cruelty to Animal Act, 1960.

Allegation is that the accused persons were carrying five cows and one ox illegally from Nepal to India. It has been submitted on behalf of the petitioner that the petitioner is in custody since 28.08.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner had gone to graze his cattle as he resides in the border area. The petitioner had no intention to commit any offence under Animal Cruelty Act.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Kishanganj in connection with Terhagachh P.S. case No.126 of 2019.
