The petitioners claimed to be Rice Mill Owners of the district of Gaya filed the present writ petition seeking quashing of the order dated 22.11.2022 contained in Memo No. 5248 issued by the Secretary, Food and Consumer Protection Department, Government of Bihar whereby and whereunder a direction was issued to all the Collectors of the State of Bihar to give priority for manufacturing of arwa rice to the rice mills, which are running under the Cooperative Societies (PACS).

In course of argument, it has been informed to this Court that the aforenoted impugned letter was issued in compliance of the policy decision taken by the State Government as also in the light of the Notification No. 4744 dated 17.10.2022 for paddy procurement season 2022-23 and now the procurement year has already come to end on 13.09.2023. Thus in any view of the matter, no relief can be granted to the petitioners as the same has become infructuous.
