JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2018 Petitioner prays for bail in connection with Baikunthpur P.S.Case No. 258 of 2018 registered for the offences punishable under Sections 30(a), 41, 32(b)(ii) and 38(1) of Bihar Prohibition and Excise Act.

Allegation as per FIR is that one vehicle loaded with liquor was intercepted by police and persons sitting in the vehicle succeeded in fleeing away and driver disclosed the name of the petitioner and it further appears that on the instruction of Officer-in-Charge the vehicle was released and as such the Officer-in-Charge and other co-accused persons have been made accused in this case.

Submission of learned counsel for the petitioner is that except confessional statement of driver there is nothing against him and he is in custody since 8.11.2018, having no case

Having heard both sides and in the facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional District Judge-II-cum-Special Judge, Excise, Gopalganj, in connection with Bainkunthpur P.S.Case No. 258 of 2018, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned.
