JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-01-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Khagaria P.S. Case No. 661 of 2018, G.R. No. 2692 of 2018 for the offenses under Sections 272 and 273/34 IPC and section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation against the petitioner is that he was carrying cough syrup which is used as substitute for liquor. Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 26.09.2018.

Considering the aforesaid facts and circumstances and the fact that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.77178 of 2018(2) dt.10-01-2019 2/2 bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge cum- I/C Special Judge, Excise Act, Khagaria in connection with Khagaria P.S. Case No. 661 of 2018, G.R. No. 2692 of 2018.
