1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Sultanganj Police Station Case No. 221 of 2025, disclosing offences under Sections 115(2), 126(2), 109, 351, 352 and 3(5) of the BNS, 2023.
3. As per the FIR, on 10.06.2025, in the evening, petitioner along with other accused persons abused and assaulted the informant. The co-accused, Sandip Bind, assaulted the informant by means of iron rod, and when the son of the informant intervened, he was also assaulted by co-accused Sandip Bind.

4. Learned counsel for the petitioner submits that both the parties are neighbors and there is a case and counter case between them, inasmuch as, Sultanganj P.S. Case No. 220 of 2025 has been lodged by the sister-in-law of the petitioner. No specific overt act has been alleged against the petitioner in the entire FIR and the allegation against him is general and omnibus in nature.

Having regard to the submissions made on behalf of the parties and taking into consideration the fact that specific overt act is not there against the petitioner, there is case and counter case between the parties and both the parties are neighbors, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1, Bhagalpur, in connection with Sultanganj Police Station Case No. 221 of 2025, subject to the condition laid down under Section 438 (2) of the Code of Criminal
