The petitioner seeks bail in anticipation of his arrest in connection with Amdabad P.S. Case No. 119 of 2017 dated 09.08.2017 instituted for the offences under Sections 341, 323, 307 and 34 of the Indian Penal Code.

The petitioner is said to have inflicted two knife blows on the informant leading to injuries on his trachea, below the thyroid gland and on the left side of chest. Learned counsel for the petitioner however has submitted that the injuries said to have been inflicted by the petitioner are simple in nature and that there is counter case also with respect to the dispute between the parties and scuffle ensuing thereupon. That apart, Mr. Bimal Kumar, learned advocate has submitted that the dispute is basically between the family of Mishra

Patna High Court Cr.Misc. No.15810 of 2018(2) dt.06-04-2018 2/2 Mandal, the informant of the present case and Sitaram Mandal and only because the petitioner happens to be the son-in-law of aforesaid Sitaram Mandal, he has deliberately been made accused in the present case for troubling the family of Sitaram Mandal.

Considering the aforesaid facts viz. the simple injuries allegedly to have been caused by him and there being a counter case, this Court is inclined to grant anticipatory bail to the petitioner. While saying so, this Court has also taken into account that the petitioner does not have any criminal antecedent.

The petitioner above named is directed to be released, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Amdabad P.S. Case No. 119 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
