JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Buxar Mahila P.S. Case No. 38 of 2019 registered for the offences punishable under Sections 498A. 341, 323, 354, 34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.

As per FIR allegation against the petitioner is that he demanded two kathas of land and one four wheeler and for that the informant was ousted from the house.

Submission of learned counsel for the petitioner is that marriage was solemnized in the year 2010 and whole allegation is false and he is still ready to keep her with dignity and care and earlier also petitioner had taken her and they were residing together and later on reconciliation failed and order-

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender within a period of three weeks from the receipt of this order and on surrender he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Buxar, in connection with Buxar Mahila P.S. Case No. 38 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that if informant is ready to reside with the petitioner, petitioner has to keep her with dignity and care, otherwise she is at liberty to move for cancellation of bail bonds of the petitioner in the court below itself.
