JUSTICE SANDEEP KUMAR ORAL ORDER 16-08-2023 This is an application for quashing of the order dated 04.11. 2022 passed by the learned Addl. Sessions Judge 5th Vaishali at Hajipur in Sessions Trial No. 437 of 2021 by which the application filed by the petitioner on 28.02.2022 for discharge has been rejected.

2. As per the complaint, the husband of the complainant was working as Guard in the Saint Paul Hostel at Gandhi Ashra, Hajipur and he had eight months salary dues with one R.K. Singh who was running the Security Agency and in the meantime the husband called the complainant and told her that petitioner and some other person are running a committee in which he had invested money will become double in one year and the husband gave Rs. 1 lakh to them but next day the complainant got information that her husband is serious and found her husband dead.

3. I have heard both the parties.

4. From perusing the materials available on record, strong prima facie case has been found against the petitioner and there is no merit in this application.
