The petitioner is apprehending his arrest in connection with Hasanpur P.S.Case no.184 of 2015 registered for offences punishable under Sections 302/34 of the Indian Penal Code. Allegation against the petitioner is that he has taken the deceased along with him and thereafter his dead body was found on the next day.
Submission of the learned counsel for the petitioner is that except last seen there is nothing against the petitioner and he has been made accused only on the basis of suspicion. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, this application is disposed of with
Patna High Court Cr.Misc. No.14058 of 2018 (2) dt.10-04-2018 2/2 a direction to the petitioner to surrender before the learned court below within a period of four weeks from the date of order and on his surrender he will be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Sri D.K. Bhaskar, J.M. 1st class, Rosera, District Samastipur in connection with Hasanpur P.S.Caase no.184 of 2015, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure, with condition that once the charge-sheet is submitted against him, he will move for regular bail, which will be considered on the basis of the materials available at that time.
With the aforesaid observation, this application is disposed of.
