2. The petitioner is apprehending his arrest in a case in connection with Taraiya P.S. Case No. 284 of 2024 dated 30.06.2024 registered for the offences punishable u/ss 413, 414, 420, 467, 468, 471, 307 read with Section 34 of the Indian Penal Code, Section 27 of the Arms Act and u/s 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 40 litres of spirit, one iron cutter, one iron rinch, a big rod, three cartridges shells were recovered from the Scorpio vehicle.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner has transpired in this

It is further submitted that the petitioner is not the owner of the said vehicle and he has no concern with the alleged recovery. The co-accused person has already been granted regular bail by this court vide order dated 10.09.2024 passed in Cr. Misc. No. 64189 of 2024. The petitioner has one criminal antecedent as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the anticipatory bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on anticipatory bail on furnishing bail-bond of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court concerned, Saran at Chapra in connection with Taraiya P.S. Case No. 284 of 2024, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.

7. The application stands allowed.
