ANJANA MISHRA ORAL ORDER 05-11-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor on behalf of the State. The petitioner is in custody since 28.09.2019, in connection with Siwan Muffasil P.S. Case No. 369 of 2019 for the offenses under Sections 30 (a) of the Bihar Prohibition & Excise (Amendment) Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were not made from the conscious possession of the petitioner but from a plastic bag which does not belong to the petitioner. It is further submitted that the petitioner has got clean antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on

Patna High Court CR. MISC. No.69849 of 2019(2) dt.05-11-2019 2/2 furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Judge, Excise, Siwan, in connection with Siwan Muffasil P.S. Case No. 369 of 2019.
