JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 05-04-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Govindganj P.S. Case No.267 of 2016 registered under Sections 147, 148, 149, 323, 324, 448, 379 and 504 of the Indian Penal Code.

Considering the submissions made by Mr. Uma Kant Shukla, learned counsel appearing for the petitioners, that there is case and counter case in which members of both sides sustained injuries and there is no specific allegation so far as the petitioners

Patna High Court Cr.Misc. No.18268 of 2018 (2) dt.05-04-2018 2/2 are concerned as also that one Sharda Nand Giri, a co-accused against whom there is similar allegation, has already been granted pre-arrest bail by a Bench of this Court vide Cr. Misc. No.17706 of 2018, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari in connection with Govindganj P.S. Case No.267 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
