The petitioner apprehends his arrest in a case registered for the offence under Sections 341, 323, 307, 379, 504/34 of the Indian Penal Code.

As per F.I.R., this petitioner is alleged to have assaulted on the head of son of the informant by iron rod. It is submitted on behalf of petitioner that petitioner has been falsely implicated in this case. In fact, due to dispute between the parties over path way (Gali), a simple occurrence of Maarpit took place. There is delay of five days in lodging the F.I.R. without there being any plausible explanation of delay. Petitioner has got clean antecedent.

Learned A.P.P. for the State and learned counsel for informant vehemently oppose the prayer for anticipatory bail.

No.4178 of 2023(2) dt.13-04-2023 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Bhojpur at Ara in connection with Bihiya P.S. Case No. 211 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
