Petitioner seeks bail in Neemchak Bathani P.S. Case No. 85 of 2013 registered for the offence punishable under Sections 302, 201/34 of the Indian Penal Code. Allegation against the petitioner is of committing murder of the sister of the Informant alongwith FIR named accused.

It has been submitted on behalf of the petitioner that he is innocent and has been falsely implicated in this case. It has been further submitted that the petitioner was not present in the village at the time of occurrence. Petitioner has got no criminal antecedent and is in custody since 22.06.2018. Considering nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail at this stage.

Patna High Court Cr.Misc. No.62907 of 2018(3) dt.27-11-2018 2/2 Hence, the prayer for bail of the petitioner is hereby rejected. However, it is observed that petitioner would be at liberty to renew his prayer for bail after completing one year of Jail custody.
