2. The petitioner apprehends his arrest in a case registered for the offence punishable under Section 394 of the Indian Penal Code.

As per prosecution case, on 18.06.2024 at 11 o'clock, while the informant, along with one Deepak Kumar, was returning after withdrawing cash of Rs. 60,000/- each and reached near Chimni Bhatta at Bedaul, this petitioner, along with other accused persons, over took them and on the point of pistol, snatched cash and other belongings.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is quite innocent and has committed no offence as alleged in the F.I.R.. Petitioner has falsely been implicated in this case due to previous money

Patna High Court CR. MISC. No.80651 of 2024(3) dt.23-01-2025 2/3 dispute between the parties. As a matter of fact, petitioner runs a poultry farm named Khushi Enterprises and the informant runs a C.S.P. (Customer Service Point) at village- Coraut at P.N.B. Pupri. It is further submitted that some altercation took place between the parties while depositing money and taking advantage of the situation, this false and concocted case has been lodged. As a matter of fact, on the alleged date and time of occurrence, petitioner was 30 Km away from the alleged place of occurrence, attending a function at a relatives house. No incriminating article has been recovered from possession of this petitioner. Petitioner claims clean antecedents.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner and submitted that petitioner is named in the F.I.R. and there is specific accusation that he, along with other accused persons named in the F.I.R., stopped the informant and on the point of pistol snatched Rs. 60,000/- from the informant and Rs. 60,000/- from Deepak Kumar. It is further submitted that informant has identified this petitioner as the one who has committed the offence.

6. Considering the aforesaid facts and circumstances and specific and direct nature of accusation, the prayer for grant
