2. The petitioner seeks bail in connection with Sasaram (M) P.S. Case No. 241 of 2023 instituted for the offences punishable under Sections 307, 325, 323, 341, 504, 147, 148, 149 of the Indian Penal Code; Section 27 of the Arms Act and later on Section 302 of the IPC was also added.

3. The prosecution case as per FIR is that all the FIR named accused persons including the petitioner came variously armed at the house of the informant and surrounded the informant and his cousin Anuj Kumar @ Sonu. Thereafter, on order of co-accused Akhilesh Chaudhary, all the accused persons started making assault to the informant and other family members.

4. Learned counsel for the petitioner submits that

From perusal of the impugned order, it appears that there is general and omnibus allegation against this petitioner. Learned counsel for the petitioner further submits that similarly situated co-accused persons namely Ravi Chaudhary @ Ravi Kumar and Pulish Chaudhary @ Pulish Yadav @ Pulis Chaudhari have been granted bail by a co-ordinate Bench of this Court in Cr. Misc Nos. 56183 of 2023 and 60276 of 2023 dated 18.10.2023 and 12.09.2023 respectively. Petitioner has no criminal antecedent and is in custody since 13.05.2023.

5. Learned APP opposes the prayer for regular bail.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram (M) P.S. Case No. 241 of 2023.
