JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 01-02-2024 Prayer in this writ application is to direct the respondent authorities to conduct a proper and fair investigation of Kasim Bazar P.S. Case No. 305 of 2023 instituted for the offences alleged under Sections 419, 420 and 333 of the Indian Penal Code and Section 15(2)(3) of the Indian Medical Act read with Medical Termination of Pregnancy Act. The petitioner also prays for a direction to the respondent authorities to arrest the accused persons.
2. A counter affidavit has been filed. It is the stand of
Patna High Court CR. WJC No.1901 of 2023(2) dt.01-02-2024 2/2 the investigating agency that the petitioner is highly interest in arrest of the accused persons who have been treated under Section 41A Code of Criminal Procedure by the investigating agency. It is stated that in view of the judicial pronouncements of the Hon'ble Court as well as the provision of Cr.P.C., the accused persons have been dealt with. It is further stated that the investigation in this case is complete and a charge-sheet has been filed whereupon the matter is sub judice before the competent court of law.
3. Learned counsel for the petitioner does not dispute the fact that the charge-sheet has already been filed.
4. In the aforesaid view of the matter, this Court finds no reason to proceed with the writ application. It is disposed of as nothing remains for adjudication in the present writ application.
