====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 04-12-2019 Heard learned counsel for the parties.

The petitioner was allowed bail in connection with Samastipur Excise Case No. 183 of 2019 on condition that if the trial is not concluded within six months from the date of framing of the charge, the petitioner would be released. The said order was passed on 09.09.2019 in Cr. Misc. No. 56186 of 2019. Prayer is for modification of the condition on the ground that charges have already been framed. However, the trial has not concluded and the petitioner has to appear in the examination.

Finding substance in the submission aforesaid, prayer for modification is allowed.

Let the petitioner, above named, be released on bail,

Patna High Court CR. MISC. No.70611 of 2019(2) dt.04-12-2019 2/2 at once, on execution of the bail bond as directed earlier. Let a copy of this order be communicated to the Court of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Samastipur in connection with Samastipur Excise Case No. 183 of 2019.
