The petitioners seek anticipatory bail in connection with Mohania PS case no. 720 of 2017 dated 27.12.2017 registered for the offences punishable under Sections 461, 379 and 34 of the Indian Penal Code.

The allegation in the present case is regarding the accused persons breaking the kiosk of the informant herein and one person namely Sonu Kumar Ram was arrested who is said to have disclosed the named of the petitioners herein. The learned counsel for the petitioners submits that there is no eye witness to the allegations of the petitioners breaking the kiosk of the informant and the petitioners are having a clean

Patna High Court Cr.Misc. No.10253 of 2018 (2) dt.21-02-2018 2/2 antecedent. It is submitted that merely on disclosure of the name of the petitioners, they have been falsely implicated in the present case.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the concerned court within a period of six weeks from the date of receipt/production of a copy of the present order, the petitioner above named is directed to be released on anticipatory bail on furnishing bonds of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhabua, in connection with Mohania PS case no. 720 of 2017, subject to the conditions laid down under Section 438(2) of Code of Criminal Procedure.
