Petitioners apprehend their arrest in Amas P.S. Case No.59 of 2017 for the offences under Sections 147, 323, 302 of the I.P.C.
Allegation against the petitioners is that all the petitioners caught hold of the deceased and other accused persons had pressed the neck of the deceased causing his death. Learned counsel for the petitioners submits that the post mortem report does not support the prosecution case so far the manner and the mode of occurrence and other co-accused who also caught hold of the deceased has already been granted anticipatory bail vide order dated 7.9.2017 passed in Cr.Misc.
Patna High Court Cr.Misc. No.12892 of 2018 (2) dt.03-04-2018 2/2 No.40922 of 2017.

Having heard both sides and in view of the facts and circumstances and also the fact that other similarly situated coaccused has already been granted anticipatory bail, prayer for anticipatory bail is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of J.M1st Class, Sherghati, in Amas P.S. Case No.59 of 2017 subject to the conditions as laid down under Section 438(2) of Cr.P.C. and further conditions that his bailors must be of local having sufficient immovable property within the jurisdiction of the Court and the petitioner shall cooperate in the investigation.
