====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-05-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 471, 120(B)/34 of Indian Penal Code.

It is alleged that this petitioner along with his brother, sister-in-law and other related persons have taken total Rs. 8 lacs from the informant on different dates through cash and digital mode for the purpose of providing service in CISF and thereafter, got prepared forged and fabricated appointment-cumtraining letter in CISF. It is further alleged that when the informant demanded his money from the accused persons, they refused to return the same.

No.3429 of 2023(2) dt.09-05-2023 2/2 Learned counsel appearing for the petitioner submits that petitioner never received any money from the informant either through bank account or cash for the purpose appointment in the CISF. He next submits that to secure appointment through unfair means in itself is an offence and unlawful. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P. S. Case No. 436 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
