The petitioner in this writ petition seeks direction to the respondents to pay the retiral benefits such as Provident Fund, Group Insurance and arrears of salary of the petitioner. The learned counsel for the petitioner submits that
Patna High Court CWJC No.23105 of 2019(10) dt.08-03-2021 2/2 petitioner retired from service on 28.02.2015 of the Multi State Co-operative Land Development Bank. The petitioner filed petition for payment of his retiral dues. The petitioner was sent on deputation in the Bihar State Food & Civil Supplies Corporation in the year 2007 and from there the petitioner retired. The SFC filed counter affidavit stating that the SFC has already paid EPF amount of the petitioner and the petitioner is not entitled to get any other pensionary benefits. The Bank has also stated that petitioner is not entitled to get any pension. The Bank is not amenable to writ jurisdiction and the writ petition is not maintainable.
Having considered the facts aforesaid, this writ petition is disposed of with a direction to the Multi State Cooperative Land Development Bank, Patna to pay the Group Insurance amount to the petitioner, if the same is still lying due, in accordance with law.
With the aforesaid direction, this writ petition is disposed of.
