The petitioner has prayed for bail in connection with Pakriwaraw P.S. Case No. 328 of 2018 registered for the offences under Section 30(a) of Bihar Prohibition & Excise Act. As per allegation in the FIR, 400 ltrs of country made wine was recovered from Bolero vehicle.
It is submitted by learned counsel for the petitioner that the driver of the vehicle Mukesh Kumar was arrested who has given a confessional statement before the police naming a co-accused Karu Yadav, not the petitioner herein. Later on, the police have changed the description of Karu Yadav by that of the petitioner. It is further submitted that the petitioner is in custody

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge II cum Special Judge, Excise, Nawada, in connection with Pakriwaraw P.S. Case No. 328 of 2018.
