17-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in relation to Sono P.S. Case No. 250/2017 registered under Sections 399, 402 of the Indian Penal Code and Section 25(1-b)a/26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the name of this petitioner has transpired in the confessional statement of one Md. Mukhtar @ Karu Miyan who was arrested by the police and from whose possession one country made pistol and live cartridge were recovered. So far as the present petitioner is concerned, he has been falsely implicated, he was not caught on the spot and above all he has no criminal antecedent.

Patna High Court Cr.Misc. No.7231 of 2018 (2) dt.17-02-2018 Learned Additional Public Prosecutor for the State is present.

Considering the fact that the petitioner having clean antecedent and save and except statement of Md. Mukhtar @ Karu Miyan no other material has been brought to the notice of this court to connect the present petitioner with the alleged occurrence, in the event of his arrest/surrender before the court below within four weeks, let the above named petitioner be enlarged on bail on furnishing bail bonds of Rs. 15,000/- (fifteen thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1ST Jamui, in connection with Sono P.S. Case No. 250/2017, subject to condition laid down under Section 438 (2) of the Code of Criminal Procedure.
