The petitioner is seeking direction restraining the Circle Officer, Wazirganj, in the District of Gaya, from disturbing his peaceful possession over the land in question as described in paragraph-4 of the writ application. The petitioner claims that she has rightful title and possession over the land in question, in respect of which, a decree has also been passed in a title suit by a competent court of civil jurisdiction. It is the petitioner's case that the respondents are claiming that the said land has been settled through Parcha in favour of the privileged tenants.

In my opinion, this writ application is premature inasmuch as except for a vague statement that the respondents are approaching and telling about settlement of her land through Parcha, there is no such cause of action, which could have been a valid basis for this Court to have taken cognizance of.

4. In any view of the matter, the petitioner has alternative remedy by approaching authorities under statutory provisions at appropriate stage.

5. This writ application is disposed of with the aforesaid observation and liberty to the petitioner to approach appropriate forum.
