The petitioner apprehends arrest in Bihta P.S. Case No. 421 of 2014, S.Tr. No. 112 of 2016, instituted for the offence under Sections 364,302,201,120(B) of the IPC. Learned counsel for the petitioner has submitted that other co-accused persons with similar allegation faced trial by Sessions Trial No. 112 of 2016 and they have been acquitted by the court below.
Learned Sessions Judge has mentioned in impugned order that this petitioner has absconded during trial. He has been declared absconder and remained absconding during entire trial of the other accused persons.
In such circumstances, this Court is not inclined to
Patna High Court Cr.Misc. No.11284 of 2018(3) dt.30-03-2018 2/2 grant bail to the petitioner.
Accordingly, this anticipatory bail petition stands rejected.
The petitioner is directed to surrender in the court below within six weeks from date of receipt of the order and seek regular bail which will be considered by the court below in accordance with law and disposed off, without being prejudiced by this order.
