The petitioners seek pre-arrest bail in connection with Sarai P.S. Case No.203 of 2014 registered under Sections 323, 324, 341, 354A, 379, 504 and 509 read with 34 of the Indian Penal Code.
On perusal of the order dated 05.01.2018 passed in A.B.P. No.2204 of 2017 by the learned Additional Sessions Judge-II, Hajipur by which the prayer for pre-arrest bail of the
Patna High Court Cr.Misc. No.12570 of 2018 (2) dt.28-02-2018 petitioners was rejected, I find that in course of investigation, the petitioners were arrested by the police and were released on furnishing bond.
In that view of the matter, this application under Section 438 of the Cr. P.C. would not be maintainable. Accordingly, it is dismissed as not maintainable. (Ashwani Kumar Singh, J.) Sanjeet/- U T
