2. The petitioner seeks bail in connection with Amnour P.S. Case No. 164 of 2024 registered for the offences under Sections 395 and 412 of the IPC.

3. The petitioner is not named in the F.I.R. and is in custody since 21.06.2024.

4. The allegation against the petitioner is to commit dacoity in Central Bank of India, Apher Branch along with other co-accused persons and while committing so, looted cash of Rs. 8,94,988/-.

5. Learned counsel appearing on behalf of the

No.88785 of 2024(5) dt.28-02-2025 2/3 petitioner submitted that the name of petitioner transpired in the present case on the basis of self-confession while he was remanded in Amnour P.S. Case No. 170 of 2024 registered for the offences as punishable under Sections 399, 402 of the IPC and Section 25(1-b) 26 of the Arms Act. It is submitted that on the basis of suspicion arising out of self-confession nothing incriminating recovered/surfaced during the course of investigation, so as to connect this petitioner prima facie with the present occurrence of dacoity. It is submitted that petitioner was not put on T.I.P. as yet. While concluding the argument it is submitted that beside this case petitioner found involved in one more criminal case i.e., Amnour P.S. Case No. 170 of 2024, where he is on bail and moreover, investigation has been completed, for which, charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

7. In view of the facts and circumstances as mentioned above and by taking note of fact as save and

No.88785 of 2024(5) dt.28-02-2025 3/3 except suspicion arising out of self-confession nothing appears incriminating during the course of investigation so as to connect this peitioner prima facie with the present occurrence of dacoity, coupled with the fact as petitioner is in custody since 21.06.2024, where charge-sheet has already submitted, accordingly, petitioner, above named, is directed to be released on bail in connection with Amnour P.S. Case No. 164 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Saran at Chapra/concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480 (3) of the BNSS.
