Petitioner apprehend his arrest in connection with Deo P.S. Case No. 73 of 2019 instituted for the offence under Section(s) 406,409 and 420/34 and of the Indian Penal Code. It is submitted by the petitioner's counsel that from the measurement book, copy of which has been placed on record by way of supplementary affidavit, it is apparent that the works, in relation to which the F.I.R. has been lodged, have been completed. The measurement book relied upon by the petitioner is of late August, 2019. The F.I.R. alleging misappropriation of fund meant for completing the 'Saat Nischaya Yojana, Har Ghar Nal Ka Jal' was lodged in June, 2019 itself. The nature of allegations are having socio economic

Considering the rival submissions of the parties, this Court is not inclined to extend the privilege of anticipatory bail to the petitioner. The prayer of the petitioner for grant of anticipatory bail is rejected. This order passed by this Court in the instant case, however, would not prejudice the petitioner's case for grant of regular bail before the learned Court below.
