JUSTICE SANJAY PRIYA ORAL ORDER 3/ 23-03-2018 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner apprehends his arrest in Forbesganj P.S. Case No.296 of 2017 instituted for the offence under Section(s) 341, 323, 307, 506 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Araria.

It is alleged in the written report that the informant found this petitioner in compromising position with his widow sister. When he raised objection, then this petitioner assaulted the informant with Dabiya several times as mentioned in the written report causing injury on his head, cheek, neck, chest etc. Case diary has been received, wherein, Injury Report is available. It is mentioned in the Injury Report that three lacerated injures were found on the person of the informant

Patna High Court Cr.Misc. No.8493 of 2018 (3) dt.23-03-2018 2/2 caused on the head, cheek, neck etc. and opinion has been kept reserved.

In this manner, Injury Report supports the allegation that the petitioner gave several blows on the person of the informant.

In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.

Prayer of the petitioner for grant of anticipatory bail is rejected.

Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off in accordance with law merit without being prejudiced by this order.
