1. Heard learned counsel for the petitioner and learned AC to GP-22.

2. The learned counsel for the petitioner submits that petitioner would be satisfied in the event if the writ application is disposed of with a direction to the Divisional Commissioner, Tirhut Division, Muzaffarpur to dispose of the appeal filed by the petitioner being Appeal Case No. BLDR Appeal No. 2017 of 2024 against the order passed by the DCLR, Bagaha, West Champaran in Land Dispute Resolution Case No. 86 of 2023-24 within a time frame.

3. The learned counsel appearing on behalf of the State objects to the said submission made by the learned counsel

Patna High Court CWJC No.18112 of 2024(2) dt.10-12-2024 2/2 appearing on behalf of the petitioner and submits that Divisional Commissioner, Tirhut Division has not been impleaded as party respondent though a pleading has been made that appeal is pending in his Court against the order of the DCLR.

4. The learned counsel for the petitioner submits that inadvertently, the Divisional Commissioner, Tirhut Division, Muzaffarpur could not be impleaded as a party respondent as such petitioner be permitted to implead the Divisional Commissioner, Tirhut Division Muzaffarpur as respondent no. 6.

5. In view of the submission made by the learned counsel appearing on behalf of the petitioner, the learned counsel is permitted to add Divisional Commissioner, Tirhut Division, Muzaffarpur as party respondent.

6. After hearing the learned counsel for the parties, the writ application is disposed of with a direction to the Divisional Commissioner, Tirhut Division, Muzaffarpur to dispose of the appeal being BLDR Appeal No. 217 of 2024 in accordance with law within a period of three months from the date of receipt/production of a copy of this order without giving undue adjournment to any of the parties.
