The petitioner apprehends his arrest in a case registered for the offence punishable u/s 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 352, 351(2) of B.N.S.

Allegedly, petitioner along with some known and unknown co-accused persons assaulted the informant and others. One co-accused person snatched gold chain from one, Manish Kumar Singh.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in

Patna High Court CR. MISC. No.82435 of 2024(2) dt.11-12-2024 2/2 the manner as alleged, has ever taken place. Both parties are covillagers and there is land dispute between the parties. It is further submitted that similarly situated co-accused person has been granted anticipatory bail by a co-ordinate Bench of the Court vide order dated 20.11.2024 passed in Cr. Misc. No. 77099 of 2024. Petitioner has no criminal antecedent. 5.

Learned APP for the State and learned counsel for the informant opposed the prayer for bail.

Having regard to the facts and circumstances of the case, and the fact that similarly situated co-accused person has been granted bail by a co-ordinate Bench of the Court, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Ara Muffasil P.S. Case No.223 of 2024, subject to the conditions as laid down under Section 482(2) of the BNSS, 2023. (Anjani Kumar Sharan, J) priyanka/- U T
