JUSTICE ASHUTOSH KUMAR ORAL ORDER 04-05-2018 The petitioner seeks bail in anticipation of his arrest in connection with Dhanarua P.S. Case No. 474 of 2017 dated 20.10.2017 instituted for the offence under Section 414 of the Indian Penal Code.

One motorcycle was spotted by the police party during checking which had two different registration numbers; one in the front and the other at the back. This raised suspicion in the mind of the police party and the motorcycle was intercepted. One Kamlesh Kumar was arrested who disclosed the name of the petitioner as the pillion rider who had managed to make good his escape.

The learned counsel for the petitioner has submitted that petitioner has no idea about the ownership of the

Patna High Court Cr.Misc. No.25674 of 2018 (2) dt.04-05-2018 2/2 motorcycle. He was only a gratuitous passenger and only to avoid further trouble, he ran away from the place. That apart, it has been submitted that his implication in the present case is only on the basis of confession of an arrested accused person. The petitioner is a student and does not bear any criminal antecedent. Co-accused Kamlesh Kumar, who has been arrested and on whose confessional statement, the petitioner is sought to be prosecuted in this case, has already been granted bail.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before learned Court below within a period of four weeks from today, be released on bail on his furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Masaurhi in connection with Dhanarua P.S. Case No. 474 of 2017.
