JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 11-05-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Pandaul P.S. Case No. 217 of 2022, registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Section 30(a), 36/38/41 (I) of Bihar Prohibition and Excise Act, 2016.

As per allegation, 993.6 liters of foreign liquor was recovered from the joint house of the petitioner. The learned counsel for the petitioner has submitted that he is a person of clean antecedent and is under custody since 10.11.2022.

Considering the above-mentioned facts and

No.7812 of 2023(2) dt.11-05-2023 2/2 circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Madhubani in connection with Pandaul P.S. Case No. 217 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) In verification done by the learned court below, if it is found that the petitioner is involved in any other case except the present one, the learned court below shall be at liberty to cancel his bail bond.
