Petitioner is apprehending his arrest in connection with Dariyapur P.S.Case No.314 of 2019 , registered for offences punishable under Sections 302/34 of the Indian Penal Code. As per FIR one Dinesh Sharma has informed the informant about the death of his son and stated that he had seen the petitioner and other accused perosns fleeing away from the place of occurrence and as such he suspected the hands of the petitioner in killing of his son. Submission of the learned counsel for the petitioner is that the statement of Dinesh Sharma has been recorded in para 67 of the case diary and he has not supported the prosecution case and stated that he had seen that the
Patna High Court CR. MISC. No.73402 of 2019(3) dt.16-12-2019 2/2 deceased met with an accident and that he has informed to the informant.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Saran at Chapra in connection with Dariyapur P.S.Cae No.314 of 2019 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
