SONI SHRIVASTAVA ORAL ORDER 08-07-2025 Both the husband and wife along with their learned counsel are present before the Court.
2. The petitioner apprehends his arrest for the offences punishable under Section 341, 342, 323, 498A, 406, 504 and 506/34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act.
3. Petitioner is the husband of opposite party no.2. The allegation is of demand of dowry and torture.
4. By earlier order dated 18.06.2025, it was agreed that the parties would be personally present and petitioner would take his wife with him from the Court premises itself. The petitioner is ready for the same but he has very strong
Patna High Court CR. MISC. No.79312 of 2024(5) dt.08-07-2025 2/3 objections to the allegation of the wife imputed against him in the last part of the F.I.R. with regard to his sister.
5. On the other hand, opposite party no.2 states that she would never in future make any such allegation against her husband and she is only interested in living peaceful conjugal life along with her husband.
6. In such view of the matter, let the above named petitioner, be released on provisional bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Gopalganj in connection with Mahila P.S. Case No.19 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
7. Both the parties are directed to appear before the learned Court below on 11th of July, 2025 and the petitioner would take his wife along with him from the premises of the learned Court below and the bail bonds of the petitioner would be accepted by the learned Court below only after being assured that both the parties are going together with a view to lead a peaceful conjugal life. The learned Court
