The petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

As per the FIR, there is recovery of 5097.600 liters of foreign liquor.

Learned counsel for the petitioner submits that there is no recovery from the conscious possession of the petitioner rather it was recovered from the truck which was parked at NH28. Learned counsel fort the petitioner further submits that petitioner is found to be involved in similar nature of three case, out of which, petitioner has been granted bail in two cases. He

Patna High Court CR. MISC. No.70639 of 2019(2) dt.25-11-2019 2/2 further submits that the petitioner is in jail custody since 22.08.2019.

In the facts and circumstances of the case, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District Judge-cum-Special Judge, Excise, Gopalganj in connection with Excise Case NO.227 of 2019 Subject to condition that the petitioner will deposit Rs.20,000/- (Twenty thousand) in the Patna High Court Legal Services Committee, Patna.
