This application, for grant of anticipatory bail, arises out of Phulwaria Police Station Case No. 116 of 2017, disclosing offences under Sections 147, 148, 149, 153(A), 353(A), 295(A), 332, 327, 337, 307 and 427 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. There is general and omnibus allegation against the petitioner and no specific over act is attributed to him. Moreover, co-accused, Sonu Kumar Rai, Mantun Rai @ Nagendra Rai @ Nagendra Rai and Sumit Rai @

Patna High Court Cr.Misc. No.7965 of 2018 (2) dt.16-02-2018 Sumit Kumar, have already been granted anticipatory bail by different Benches of this Court in Cr. Misc. No. 3077 of 2018 and Cr. Misc. No. 3951 of 2018. Hence, the petitioner deserves the privilege of anticipatory bail.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate-1st Class, Begusarai in connection with Phulwaria Police Station Case No. 116 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
