2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 302, 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner in association of other co-accused is said to have shot dead the deceased.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He submits that similarly situated co-accused have been granted bail by a Co-ordinate Bench of this Court vide order dated 19.07.2023, 11.07.2023,

Patna High Court CR. MISC. No.80916 of 2024(2) dt.20-12-2024 2/2 04.07.2023 passed in Cr. Misc No. 70064 of 2022, Cr. Misc. No. 12458 of 2023 and Cr. Misc. No. 28600 of 2024 respectively. He further submits that the petitioner is languishing in custody since 16.08.2024. The petitioner has three criminal antecedents as mentioned in para-3 of this application.

5. Learned APP for the State opposed the prayer for bail.

6. Considering the facts and circumstances of the case and the nature of the offence, this Court is not inclined to grant regular bail to the petitioner. Accordingly, the prayer of regular bail of the petitioner is hereby rejected in connection with Mufassil P.S. Case No. 366 of 2022.

7. However, the petitioner shall be at liberty to renew his prayer for bail after framing of charges. (Anjani Kumar Sharan, J) anand/- U T
