====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 12-12-2019 Petitioner seeks regular bail in connection with Jurawanpur P. S. Case No. 04 of 2019 registered for the offence punishable under Sections 341, 323, 324, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act. As per F.I.R., there is allegation against the petitioner and one co-accused that they are firing on the deceased, causing injury to him and later on, he succumbed to the injuries. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case. There is a land dispute between the parties. Further submission is that petitioner is in custody for about nine months.

On the other hand learned A.P.P as well as learned counsel for the informant, who has opposed the prayer for bail

Patna High Court CR. MISC. No.69559 of 2019(3) dt.12-12-2019 2/2 on the ground that there is direct allegation against the petitioner and postmortem report also supports the prosecution case. In view of the facts and circumstances, as stated above, at this stage, I am not inclined to grant bail to the petitioner.
