Learned counsel for the petitioner submits that inadvertently in the prayer portion of the bail petition to the satisfaction of learned Chief Judicial Magistrate, Khagaria has been mentioned on account of which in the order passed by this Court on 9.4.2018, to the satisfaction of the learned Chief Judicial Magistrate Khagaria has been mentioned In such circumstances, petitioner is directed to make necessary correction in para 13 as well as prayer portion of the bail petition during course of the day.
The order dated 9.4.18 is modified to the extent that in place of learned Chief Judicial Magistrate Khagaria, the same may be read as Chief Judicial Magistrate, Samastipur. Learned
Patna High Court Cr.Misc. No.12524 of 2018(4) dt.09-05-2018 2/2 counsel for the petitioner submits that due to such mistake the petitioner could not surrender in the court below within the time granted by this Court and only 2-3 days have been left for surrender in terms of the order dated 9.4.2018. In such circumstances, petitioner is granted three week's further time from the date of receipt of copy of this order to surrender in the Court below and in that event he will be released on the same terms and conditions as mentioned in the order dated 9.4.2018 passed in Cr. Misc. no.12524 of 2018. Let a copy of this order be communicated to District and Sessions Judge, Samastipur and Khagaria for necessary compliance.
