====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL JUDGMENT Date : 04-01-2024 Heard learned counsel for the petitioners and I intend to dispose of this petition at the stage of admission itself.

02. The instant petition has been filed seeking direction the learned Munsif-3rd, Patna, Sadar to dispose of the Eviction Suit No. 69 of 2015 within a reasonable time.

03. Learned counsel for the petitioners submits that the petitioner no. 1 is an old lady aged about 74 years and the Eviction Suit No. 69 of 2015 was filed on the ground of

Patna High Court C.Misc. No.1211 of 2023 dt.04-01-2024 2/2 personal necessity under Section 11(1)(c) of the Bihar Building (Lease, Rent and Eviction) Control Act, 1982 (for short 'B.B.C. Act, 1982). Learned counsel further submits that the evidence of the plaintiffs/petitioners has been closed 31.10.2018, still the eviction suit has not been decided till date. Learned counsel further submits that the defendant in one way or another wants to delay the matter.

04. It is unfortunate that the eviction matters are delayed for such long period, though the same are required to be decided in a time bound manner under the provisions of the B.B.C. Act, 1982.

05. Since the instant petition has been filed only seeking relief of expeditious disposal of the Eviction Suit No. 69 of 2015, the present Civil Misc. stands disposed of with a direction to the learned Munsif-3rd, Patna, Sadar to dispose of the aforesaid Eviction Suit No. 69 of 2015 within a period of six months from the date of receipt/production of a copy of this order.
