Petitioner apprehends his arrest in Khaira (Nagra) P.S. case no.177 of 2016 instituted for the offence under Section(s) 147,148, 323, 307, 504 and 506 of the Indian Penal Code. In the written report there is specific allegation against this petitioner of assaulting the son of the informant with iron rod.

Learned counsel for the petitioner has submitted that earlier a counter case was filed by the father of the petitioner against the informant and others in which the petitioner has also sustained injury. As a counter blast the instant case has been filed. It is further submitted that doctor has found sharp cut injury on his head which does not corroborate the allegation.

Patna High Court Cr.Misc. No.2450 of 2018(3) dt.15-02-2018 2/2 The injury report has been annexed as Annexure-3 wherein the doctor has found two sharp cut injury on the person of the injured. It is also mentioned in the injury report that stitches and bandage were done over the injury. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected. Petitioner may surrender before the Court below and make prayer for regular bail which shall be considered and disposed of, if possible on the same day, on its own merit in accordance with law without being prejudiced by the present order.
